Official Sweepstakes Rules

1. SPONSOR AND CONTEST DATES
   The free Nintendo Wii (“Promotion”) is sponsored and produced by Fighting Back, Inc., (“Sponsor”) on behalf of mPower.  1300 North Jackson Street, Milwaukee, WI 53202.  The Promotion begins April 1, 2009 at 12:01 a.m. Central Standard Time and ends on January 31, 2010 at 11:59 p.m. Central Standard Time.

2. ELIGIBILITY
   This contest is open to all legal residents of Wisconsin who have reached the age of majority at the time of entry.  Entrants must be present in Wisconsin at the time they enter the Promotion.  Employees of Sponsor, its companies, and immediate family members of each are not eligible.  VOID WHERE OTHERWISE PROHIBITED, TAXED OR RESTRICTED BY APPLICABLE FEDERAL, PROVINCIAL OR STATE LAWS OR REGULATIONS.  Entries will be disqualified if entrant provides information that is inaccurate or fraudulent.

3. HOW TO ENTER AND ENTRY DEADLINES
   No purchase is necessary.  There is one way to enter:

   Enter by signing up for mobile alerts about mPower.  To sign up for mobile alerts, text mpowerinfo to 30300.  Reply “YES” to the message you receive and we will send you monthly updates about mPower.  Your registration to the mobile alerts is your registration to the Promotion.

   Only one entry per person will be accepted.  Entries that are incomplete, illegible, corrupted, irregular in any way, or otherwise not in compliance with these Official Rules are void and will not be accepted.

   Sponsor, its parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors, and the employees, officers, directors, and representatives of each, are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, for any human error, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged, or postage due or for any printing or typographical errors in any materials associated with the Promotion, and all such entries are void.  No warranties are implied nor guaranteed with respect to the prize.

4. PRIZE
   One Prize Winner will receive a FREE Nintendo Wii each month from the period April 2009 through January 2010.  The approximate retail value of the prize is $250.  Sponsor reserves the right to substitute a similar prize of equal or greater value in its sole discretion.  All taxes and all other expenses associated with the acceptance and/or use of any prize are the sole responsibility of the winner.  The prize is not transferable.

5. SELECTION OF WINNER
   The winner will be selected from among all eligible entries on or about the 7th working day of each of the 10 months beginning May 2009 through February 2010, for entries received in the prior month. The odds of winning depend on the total number of entries received. The decisions of the sponsor are final. The winner will be notified no later than one week after the selection is made. The winner will be notified via text message and will have 24-hours from the time the text message is sent to respond.  If the winner does not respond during the 24-hour period, a follow up call will be made by telephone. If Sponsor does not receive a reply to the winner notification announcement by telephone during normal business hours during the week following selection, the prize will be forfeited and an alternate winner will be selected from among the remaining eligible entries. Unless prohibited by law, winner will be required to complete and return an affidavit of eligibility and a publicity/liability release within one (1) week of responding to the notification. Acceptance of prize constitutes permission (except where prohibited by law) to use winner’s name, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation. Prize award materials and information will be sent to the winner within six (6) weeks after all required proof and documentation is received.

6. CONDITIONS
   By entering, participants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final.  All applicable federal, provincial, state, and local laws and regulations apply.

   Winner assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the Promotion and/or the acceptance and/or use of any prize, and release Sponsor, its officers, directors, and employees from any such liability.  Sponsor may prohibit you from participating in the Promotion and disqualify all involved entries at the sole discretion of Sponsor, if you repeatedly show a disregard for these Official Rules, or act (i) in an inappropriate manner; (ii) with an intent to annoy, abuse, threaten, or harass any other website visitor or Sponsor representative; or (iii) disrupt the Promotion or circumvent the terms and conditions of these Official Rules. If any of the above occurs, Sponsor reserves the right to remedy any such action, disruption, or circumvention in a manner determined solely by Sponsor that is fair and equitable to Promotion participants.  All entrants agree to comply with these Official Rules.  Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law.

   If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Promotion and to award the prize from among all eligible entries received prior to the date of termination.
